AGB der IFW GmbH für den Verkauf von eSIM-Datentarifen über travelsimgo.com.
§1 Geltungsbereich & Anbieter
Diese AGB gelten für alle Verträge zwischen der IFW GmbH, Keplerplatz 3, 1100 Wien (nachfolgend „Anbieter", „wir") und dem Kunden über den Kauf von eSIM-Datentarifen. Der Anbieter richtet sich an Verbraucher im Sinne des Konsumentenschutzgesetzes (KSchG) sowie an Unternehmer.
§2 Leistungsbeschreibung
Wir vermitteln digitale eSIM-Datentarife für die mobile Datennutzung im Ausland. Die eSIM wird als QR-Code per E-Mail bereitgestellt und vom Kunden selbst auf einem eSIM-fähigen Endgerät installiert. Die Netzabdeckung, Geschwindigkeit und Verfügbarkeit richten sich nach dem jeweiligen lokalen Netzbetreiber.
Bei als „unbegrenzt" bezeichneten Tarifen gilt eine Fair-Use-Regelung: Nach Verbrauch eines täglichen Hochgeschwindigkeitsvolumens kann die Geschwindigkeit gedrosselt werden. Für Karten, Messaging, Social Media und Streaming in üblichem Umfang bleibt der Dienst nutzbar.
§3 Vertragsabschluss
Die Darstellung der Tarife stellt kein rechtlich bindendes Angebot dar. Durch Anklicken von „Kauf abschließen" und erfolgreiche Zahlung gibt der Kunde ein verbindliches Angebot ab. Der Vertrag kommt mit der Bestätigungs-E-Mail bzw. der Bereitstellung des QR-Codes zustande.
§4 Preise & Zahlung
Alle Preise verstehen sich in Euro inklusive der gesetzlichen Umsatzsteuer. Die Zahlung erfolgt über unseren Zahlungsdienstleister Stripe (Kreditkarte und weitere angebotene Methoden). Mit dem Kauf autorisiert der Kunde die Belastung des gewählten Zahlungsmittels.
§5 Lieferung & Aktivierung
Die eSIM wird nach erfolgreicher Zahlung digital per E-Mail an die vom Kunden angegebene Adresse zugestellt, in der Regel innerhalb weniger Minuten. Der Kunde ist für die Angabe einer korrekten E-Mail-Adresse verantwortlich. Der Tarif startet üblicherweise mit der Aktivierung/Einwahl im Zielland.
§6 Widerrufsrecht & Ausnahme (digitale Inhalte)
Verbrauchern steht grundsätzlich ein 14-tägiges Widerrufsrecht gemäß Fern- und Auswärtsgeschäfte-Gesetz (FAGG) zu.
Bei der Lieferung von digitalen Inhalten (eSIM-Profil/QR-Code), die nicht auf einem körperlichen Datenträger bereitgestellt werden, erlischt das Widerrufsrecht, wenn der Anbieter mit der Vertragserfüllung begonnen hat, nachdem der Kunde (a) ausdrücklich zugestimmt hat, dass mit der Ausführung vor Ablauf der Widerrufsfrist begonnen wird, und (b) seine Kenntnis vom Verlust des Widerrufsrechts bestätigt hat.
Ein Widerruf ist an info@travelsimgo.com zu richten. Nicht aktivierte eSIM-Profile werden im Kulanzweg geprüft.
§7 Gewährleistung & Endgerätekompatibilität
Es gelten die gesetzlichen Gewährleistungsbestimmungen. Voraussetzung für die Nutzung ist ein entsperrtes, eSIM-fähiges Endgerät. Der Kunde ist für die Prüfung der Kompatibilität seines Geräts vor dem Kauf verantwortlich (z. B. über die Eingabe *#06# / Anzeige einer EID).
§8 Haftung
Wir haften unbeschränkt für Vorsatz und grobe Fahrlässigkeit. Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten und begrenzt auf den vertragstypischen, vorhersehbaren Schaden. Für Störungen, Ausfälle oder Einschränkungen der lokalen Mobilfunknetze übernehmen wir keine Haftung.
§9 Anwendbares Recht & Gerichtsstand
Es gilt österreichisches Recht unter Ausschluss des UN-Kaufrechts. Zwingende verbraucherschützende Bestimmungen des Staates, in dem der Verbraucher seinen gewöhnlichen Aufenthalt hat, bleiben unberührt. Gerichtsstand für Unternehmer ist Wien.
§10 Schlussbestimmungen
Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

§1 Scope & Provider
These Terms apply to all contracts between IFW GmbH, Keplerplatz 3, 1100 Vienna, Austria (the “Provider”, “we”) and the customer regarding the purchase of eSIM data plans. The Provider addresses both consumers (within the meaning of the Austrian Consumer Protection Act, KSchG) and businesses.
§2 Description of Service
We resell digital eSIM data plans for mobile data use abroad. The eSIM is delivered as a QR code by email and installed by the customer on an eSIM-capable device. Network coverage, speed and availability depend on the respective local mobile operator.
For plans described as “unlimited”, a fair-use policy applies: once a daily high-speed allowance is used up, the speed may be throttled. The service remains usable for maps, messaging, social media and streaming at normal levels.
§3 Conclusion of Contract
The display of plans does not constitute a legally binding offer. By clicking “Complete purchase” and paying successfully, the customer submits a binding offer. The contract is concluded upon the confirmation email or the provision of the QR code.
§4 Prices & Payment
All prices are in Euro including statutory VAT. Payment is processed via our payment service provider Stripe (credit card and other offered methods). By purchasing, the customer authorises the charge to the selected payment method.
§5 Delivery & Activation
After successful payment, the eSIM is delivered digitally by email to the address provided by the customer, usually within a few minutes. The customer is responsible for providing a correct email address. The plan usually starts upon activation/registration in the destination country.
§6 Right of Withdrawal & Exception (digital content)
Consumers generally have a 14-day right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG).
For the supply of digital content (eSIM profile/QR code) not provided on a physical medium, the right of withdrawal expires once the Provider has begun performance after the customer (a) expressly consented to performance beginning before the withdrawal period expires, and (b) acknowledged the loss of the right of withdrawal.
Withdrawals should be sent to info@travelsimgo.com. Unactivated eSIM profiles are reviewed as a goodwill gesture.
§7 Warranty & Device Compatibility
Statutory warranty provisions apply. Use requires an unlocked, eSIM-capable device. The customer is responsible for checking device compatibility before purchase (e.g. by dialling *#06# / viewing an EID).
§8 Liability
We are liable without limitation for intent and gross negligence. For slight negligence we are liable only for the breach of essential contractual obligations and limited to the typical, foreseeable damage. We accept no liability for disruptions, outages or restrictions of local mobile networks.
§9 Applicable Law & Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of the state in which the consumer has their habitual residence remain unaffected. Place of jurisdiction for businesses is Vienna.
§10 Final Provisions
Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
